Bad news for all JetPeel™ copiers, imitators and fake handpiece users. On June 12, 2025, the Higher Regional Court of Düsseldorf ruled that imitations of the JetPeel™ “TripleJet” handpiece by TavTech may no longer be offered, advertised or sold. Violations can be punished with a fine of up to €250,000 or, alternatively, a prison sentence.
Prohibition of imitation handpieces
In a ruling dated June 12, 2025, the Higher Regional Court of Düsseldorf ruled that it is prohibited in commercial transactions to offer, advertise or sell certain handpieces for hydro-abrasion and/or hydroporation devices for competitive purposes if they are too similar to the JetPeel™ handpieces from TavTech, which are sold and distributed exclusively by Landsberg First Class Aesthetics.
Technical features of the original in focus
The JetPeel™ “TripleJet” handpiece from TavTech has a number of characteristic features: a slim, cylindrical shape, a transparent design, three parallel nozzles at the tip, as well as specific technical connections and details.
Unfair imitation at trade fair
A German company had presented a handpiece at the “Beauty” trade fair in Düsseldorf, which was supplied to it by an Italian company and corresponded in its essential design properties to the original JetPeel™ “TripleJet”. The Higher Regional Court of Düsseldorf considered this to be an unfair imitation and avoidable deception as to the origin. The Higher Regional Court of Düsseldorf found that the specific design of the handpiece is likely to indicate the commercial origin for the relevant public. This combination of shape, material, technical details and many years of market presence justified this protection.
The court found that both parties offer devices for skin treatment in which a fine micro-droplet jet is applied to the skin by means of compressed air.
UWG violation and clear consequences
The court also found that the handpiece of the German company, which comes from its Italian supplier, adopts the essential features of the original and is therefore an imitation. According to § 4 No. 3 lit. a UWG, an imitation is inadmissible if it causes avoidable confusion about the commercial origin. In the present case, the court found that this was the case. TavTech, which is distributed in Germany by Landsberg First Class Aesthetics, can therefore defend itself against the imitation of its product and has the right to prohibit such imitations.
Penalties for violations
The interim injunction was issued with the threat of a fine of up to €250,000 or, alternatively, a prison sentence.
